Random testing is an ongoing rate, not a one-time event

FMCSA's minimum random testing rates for 2026 remain 50% for drugs and 10% for alcohol — unchanged since 2020, because industry-wide random drug testing positive rates have stayed at or above the 1.0% threshold that keeps the rate from dropping. Carriers apply that rate across their driver pool continuously throughout the year, not as a single annual event.

The Clearinghouse changed what 'compliant' means

Under 49 CFR Part 382 Subpart G (§382.701), carriers must run a full pre-employment query in the FMCSA Drug and Alcohol Clearinghouse before any safety-sensitive function, plus an annual query for every current driver — a 'limited query' with the driver's consent can satisfy the annual requirement, but if it returns a flag, a full query is required within 24 hours. Ongoing Clearinghouse compliance is now a required part of any drug and alcohol program, not just the testing itself.
